If you make an enquiry or request using our contact form, only the personal information that you have provided will be collected and processed. The information that you provide in a contact request will be collected, processed and used solely to handle your enquiry.

 

This also includes the forwarding of this information to the internet service provider in charge of hosting our online presence. In this case, Jeunesse observes the principle of data minimisation. It shares only the minimum information which is absolutely necessary to process the enquiry. The information will also be used in order to communicate with you personally. Jeunesse does not forward your personal information provided to Jeunesse by the contact form to other third parties without your express consent, which is revocable any time.

 

Subject to the next paragraph, this processing of data is justified by the data subject’s consent. Subject to the next paragraph and exceptions pursuant to applicable legal provisions, Jeunesse stores this information until consent it revoked.            

 

If your request using our contact form is in relation to ordered products or any contract you have entered or intend to enter into with Jeunesse,  Jeunesse stores the received information as long as this is required for processing your request and any contract relating thereto. If required due to legal retention periods or in case that the data is related to any possible claims, respectively, Jeunesse will store the data until the corresponding retention period or the limitation period applicable to the corresponding claim has expired.

 

5. Collection of Personal Data as part of Contract Conclusion and Payment



Personal data will only be collected to the extent that you voluntarily disclose this information during the order process or registration process. The following information is saved as part of an order:
 

1. Name,
2. Address,
3. Telephone number,
4. Email address,
5. and possibly a delivery address that is different to the billing address,
6. Payment information.

 
Jeunesse uses this data solely for the purpose of execution of the agreement, and to communicate with you where necessary. This includes the initiation, conclusion, processing, guarantee, and where applicable, the cancellation of the purchase agreement. The information is retained until the purchase agreement has been executed in full and applicable retention periods and limitation periods expired.

 

6. Collection of Personal Information on Distributors

 

If you register with us as a Distributor, we will process additional personal data from you.

To conclude the agreement, we require the following personal information from you:


Title, name, address, email, telephone number, IP address, credit card number and expiry date, bank details, user ID and one or more of the following: Personal ID card number, tax ID number, pass number, social security number, a scanned copy of your personal ID card.

We also save your IP address and the date and time of your enquiry to allow us to detect fraud in a timely fashion.

This data processing is necessary for the establishment and execution of a contract as a Distributor It also takes place for the purpose of safeguarding the legitimate interests of Jeunesse.

For marketing purposes, Jeunesse processes the following personal information that you have forwarded to Jeunesse as part of your activity as a Distributor, or for which you have voluntarily given your consent to Jeunesse for the execution of the contractual relationship: Name, country of residence, photo, head shot image, voice recording and your statement of recommendation.


This information will be used in marketing, advertising and training materials on the radio, on the internet, in the press, in television broadcasts (including cable and satellite satellite transmissions) and in audio and video recordings. For this purpose, your personal information as listed above will be held for up to 7 years.


This data processing is necessary for the execution of a contract as a Distributor and is based on the consent that you have given It also takes place for the purpose of safeguarding the legitimate interests of Jeunesse.


As a Distributor, you will also have access to the back office. In this back office, you will have an overview of the orders that you have originated. For this purpose, you will see the following data:

 

Order number, order date, Distributor ID, name, products, order status, payment status, shipping date.

 

This information is only required for the calculation and traceability of your commission claims..


You can also obtain a team overview in the back office. Here, you will be given information on the Distributors that you have acquired in your downline.  For this purpose, you will see the following data: 


First name, surname, place of residence and country, user name, registration date, number of Distributors, number of customers acquired, date of last login, time of last participation in a webinar, account status or cancellation date, career progression level of the Distributor.


This information is only required for the calculation and traceability of your commission claims.

To process commission payments, we require the following information:

Tile, name, address, bank details.


You will also receive information here on the orders that have been authorised by other Distributors and/or customers. For this purpose, you will see the following data:

Order number, order date, order type, sum paid, name and address from shipping and invoicing information, tracking number, order source (originator).


This information is only required for the calculation and traceability of your commission claims..

Due to the requirements of commercial and tax legislation, we are obliged to store your address, payment and order data for a period of ten years or as long as applicable retention periods and limitation periods expired. However, after two years following the termination of your distributor contract, we restrict processing, i.e. your data is used only to comply with the legal obligations.


Furthermore, further to the complete processing of the contract, which also includes full payment of the agreed fees, and subject to the expiry of applicable retention periods and limitation periods the Distributor's data will be deleted.


We forward your personal information to third parties only to the extent that is necessary to execute the contract or to safeguard our legitimate interests.


For this purpose, the Distributors receive the following data from your sponsor:


First name, surname, country of registration.


Your sponsor receives the following information:


Your first name, surname, email, telephone number and user name.


This data processing is only required for the calculation and traceability of your commission claims. The information will also be required by your sponsor for your training and support.


We also use external service providers (data processing companies) to execute the contract. Separate data processing agreements are drawn up with these service providers and any third parties to which the data is provided to ensure the protection of your personal information. To carry out payment of your commission via PayCard, Allied Wallet and PayPal in the European Union and globally, we pass on the following information:


First name, surname, place of residence and country, user name, email, a scanned copy of your personal ID card and a photo for identification purposes.


This processing of data is based on the execution of the purchase agreement and on the basis of the consent which you have given.

 

7. Forwarding of Data to Third Parties


Customer data is forwarded to third parties only to the extent necessary for the purpose of contract processing. We also use external service providers (data processing companies) to execute the contract. Separate data processing agreements are drawn up with these service providers to ensure the protection of your personal information.

To carry out the delivery, the customer's first name, surname, address, email and telephone number are forwarded to the shipping companies EMARC, FedEx and TNT to enable them to complete the delivery.


To process the payment, the Distributor's payment details, namely their first name, surname, address, email, telephone number, date of birth, account details and IP address are forwarded to credit institutes or payment intermediaries. These are: Optimal, Worldpay (UK) Limited, Paysafecard.com USA, Inc., Paypal (Europe) Sarl et Cie, SIX Payment Services (Austria) GmbH, AlliedWallet Ltd., Global Collect Services, B.V. dba Ingenico, Klarna AB (PUBL), International Payout Systems, Inc.,  GlobalOneTree and Chase Paymentech Europe Limited.

 

For the purpose of timely fraud detection, the following information on the Distributor is passed on to Accertify Inc., a subsidiary of American Express in the U.S.:

First name, surname, address, email, telephone number, date of birth, Jeunesse account name, password, history and where applicable, notes that were added by Jeunesse departments, IP address, order data (including date, time, shipping costs, VAT, browser cookies, IP address, billing address, payment method, currency, failed attempts), billing data (including invoice name, address, telephone number, card type, card number, CVV code, authorised amount and card expiry date).

 

The external service provider and in particular the credit institutes or payment intermediaries may also be located abroad. Please see in this connection also section 13, in particular also with regard to the measures implemented by Jeunesse to bring the level of data protection as close as possible to that of Switzerland.

 

To the extent permitted by law we exclude any liability for the processing of data by the external service provider and compliance of the data processing by the external services provider with applicable data protection provisions.

 

8. Testimonials / Product Reviews



Jeunesse offers you the option to submit product reviews. The personal information that you make available to us in this regard based on the consent you have given voluntarily may be published on the Jeunesse website and on the social media used by Jeunesse for marketing purposes, as clarified under Section 6 of this data privacy policy. Your product review may be published for up to 60 months, depending on whether the products you have reviewed are still offered for sale by Jeunesse.


We wish to point out that the processing of your information that you provided in this context by third parties lies outside the responsibility and/or control of Jeunesse. To the extent permitted by law we exclude any liability for the processing of data by third parties and compliance of the data processing by third parties provider with applicable data protection provisions.
 

If you wish to remove your product review from the Jeunesse website and/or from social media at an earlier date, you can contact our data protection officer by sending an email to: [email protected].


This processing of data is carried out based on the consent that you have given and to safeguard the legitimate interests of Jeunesse.

 

9. Facebook Fan Page



For the information service offered on Facebook, Jeunesse accesses the technical platform and the services of Facebook Ireland Ltd., 4 Grand Canal Square Grand Canal Harbour, Dublin 2, Ireland ("Facebook").

Jeunesse makes the following information available on our Facebook fan page for the purpose of data processing:

 

(1) Responsible Persons

The processing of your personal data on the Jeunesse Facebook fan page is carried out with the joint responsibility of:

(2) Data Processing

When you access a Facebook fan page, the IP address of your end device is sent to Facebook. According to information provided by Facebook, this IP address is anonymised and is deleted after 90 days, at least if it is a Swiss IP address. Facebook also stores additional information on the end devices of its users, e.g. the web browser in use. This means Facebook may be able to assign IP addresses to individual users. When you are logged into your Facebook account while visiting our fan page, a cookie with your Facebook ID is downloaded onto your end device. Using this cookie, Facebook can see that you have searched for our fan page and how you have used this page. Facebook uses this information to present you with customised content or advertising.

If you do not want Facebook to do this, you should log out of your Facebook account or disable the "Stay logged in" function. We also recommend that you clear all cookies, close your browser and restart your device. This process will delete Facebook information that Facebook can use to make an association with you.

As the operator of the Facebook fan page, we are unable to assess the forwarding and further processing of user personal data in third countries, for example, the USA, and the associated possible risks to you as a user.

As part of the so-called "insight" function, Facebook offers a range of statistical data for SBS-Legal as a fan page operator. These statistics are generated and provided by Facebook. As the operator of the fan page, we have no influence on the generation of this data, and in particular, we cannot prevent this function. As part of the "Insights" function, we are able to view the following information for the categories "Fans", "Subscribers", "Number of persons reached" and "Interacting persons" for a definable period:

Page activities such as page accesses, page previews, transactions on a page, reach activities such as "Like" data, number of persons reached and recommendations, post activities such as post engagement, video views, comments and shared content.

Statistical information on the Facebook groups which are connected to our fan page is also provided to us. In accordance with the Facebook terms of use, to which every user has agreed when creating a Facebook profile, we can also identify the subscribers and fans of the page and their profiles, and view other information shared by them.

Jeunesse uses this data available in an aggregate form to make posts and activities on its fan page more attractive for users, for example, to plan the content and timing of posts. The legal basis for this data processing is, namely our legitimate interest in improving and optimising our offer.

(4) Retention Period

We will retain the information sent by Facebook only until you request that it is deleted or anonymised.

If you wish to opt out of the data processing outlined here in the future, then please deactivate the link between your user profile and our fan page by using the functions "Unlike this page" and/or "Unsubscribe from this page".

(5) Your Rights as an Affected Person

For any information enquiries or other questions regarding your rights, which are set out at the end of this data privacy policy, we recommend that you contact Facebook directly, as only Facebook has full access to the user data. However, if you do send your enquiry to us, we will of course process it as well as forward it to Facebook.

11. Your Rights as an Affected Person



To the extent provided for by applicable data protection law, you are entitled to request information about your data at any time and free of charge, and to demand its correction, deletion or blocking, or the transmission of the data to an entity of your choice. You may also revoke your consent to the processing methods at any time with immediate effect for the future. 12. Minors



Our products and services are aimed primarily at an adult market. Persons under the age of 18 years should not send us personal information without the consent of the parent(s) or legal guardian(s).


Jeunesse is subject to the investigatory powers of the U.S. Federal Trade Commission.


Jeunesse must disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.


In the context of an onward transfer, Jeunesse has responsibility for the processing of personal information it receives and subsequently transfers to a third party acting as an agent on its behalf. Jeunesse shall remain liable if its agent processes such personal information in a manner inconsistent with Jeunesse, unless Jeunesse proves that it is not responsible for the event giving rise to the damage.

 

13. Transfer of data abroad



Jeunesse may transfer your data worldwide to foreign contries for the purpose of processing the data as outlined in this Privacy Policy. Jeunesse implemented the following measures to bring the level of data protection as close as possible to that of Switzerland.

-      in case that the foreign country to which the data is transferred is listed by the competent Swiss authorities as country guaranteeing an adequate data protection level, adequate data protection is guaranteed by the corresponding foreign data protection laws, to include the EU and EEA member countries, Argentina, Canada, New Zealand, and Uruguay;

-     In case of transfer to other foreign countries where an adequacy determination has not been made, Jeunesse had entered into standard contract clauses approved by the competent data authorities.
